Effective from 22/10/2024 (Updated 13/05/2025)By commissioning me, you agree to the following terms of service. These terms may be updated at any time at my discretion. Failure to follow them may result in your commission being cancelled without a refund and/or refusal of future commissions.I currently accept payment via PayPal only, so please ensure you have a PayPal account ready. Payments are made in GBP (£), and it is your responsibility to cover any conversion fees. Alternatively, you may choose to pay via Ko-Fi, if available.As the artist I retain all rights to the work I create, and are not transferred to commissioners.When submitting for a commission, either via Google Forms or some other form of contact, I will contact you on the preferred method of communication, and discuss it in detail with you. Then I will send you a quote and payment invoice on PayPal, payment must be sent in full once discussions have been finalised. Once payment has been settled, I will begin working on your commission with a sketch that I will then send you via your preferred contact method. The currency I accept is GBP, and it is your responsibility for conversion fees.EDIT: 12/06/2022: Ref sheets are an absolute MUST if you have a character. If you don’t, then there are 2 options; I will design a character and a ref sheet as a commission OR find a free base online and add details, colour and other bits and pieces and I will use that as a reference.Once the sketch has been approved, I will continue working on your piece whilst still having updates on each part of the process. This will give you an idea on how the piece is coming together.As the artist, I will give you works in progress with the watermark "SAMPLE" during the working phases.Please note: The sketching process is the only time I will be able to make alterations or changes to your piece, as once the linework has been completed, there will be no changes from that point, so please make sure the sketch is to your liking before continuing.Depending on the current queue, and also the type of commission, it may take longer the more that is included. For example, a flat colour bust/icon may take one or two days, while a full body shaded piece may take more. Provided there isn’t any life event that needs my immediate attention, I will always try my best to provide quality work in good time.If you provide a reasonable deadline for your commission; such as for a birthday, Christmas, or a specific event. I will always do my best to honour it. However, if I feel the deadline is too short or unrealistic, or I know I won’t be able to complete the piece in time, I may have to decline the commission.
All deadlines must be discussed and agreed upon before work begins.If a previously agreed and reasonable deadline is not met, then you will have the right to cancel the commission, with a full refund issued. Please note that all deadline discussions are documented and easily accessible for reference.As a general rule of thumb, I will not accept commissions that include the following:
Hate art, propaganda, sexual intercourse, genitalia, taboo subjects or illegal acts, over-exaggerated bulges, genital outlines, female nipples, or any NSFW subjects.Do not enquire about these subjects, as I will decline.That said, Safe For Work versions of certain interests, whether common or niche are allowed within reason, but must be discussed beforehand. This includes themes such as transformation, hypnosis, and similar concepts, provided they stay within SFW boundaries and align with my comfort level.A refund will not be issued if I am working on a piece past the sketching phase, or after a piece has been completed. Refunds will only be accepted if I have not met a deadline or have not started work on your commission within 2 weeks of payment.Refunds do not apply to art paid for over donations and only via PayPal invoiced commissions.As the commissioner, you have the right to post your piece(s) on your own social media or websites, but credit must be given in their posts and linked back to my profile or my own post of the piece.Do not alter, recolour, trace, or claim the artwork as your own, as I will make note of this and refuse any future commissions. This also goes for reselling, use in merchandise without discussion, or NFTs.DanPhoenixArt
